DEFINITIONS
The Publisher : The person, natural or legal, who publishes the online public communication services.
The Website : All websites, web pages and online servives provided by the publisher.
The End User/ the Subscriber: The person using the site or the services.
Downloads : the download consists in the transmission and reproduction of a digital file incorporating the chosen work, on the customer’s electronic device.
Access to these files requires the use of the internet, electronic devices connected to the internet.
Ebook :
- the dematerialized form of any book, with or without a paper equivalent, the content of which includes the 1st, 2nd, 3rd and 4th covers and all illustrations and images where appropriate;
- or the dematerialised form of any audio recording of all or part of a book;
The said digitised form, by whatever means, may be viewed by the Customer from a playback device and/or any audio and/or video recording playback device.
The ebook is distributed and downloaded in computer file formats authorised by the publisher.
PDF (Portable Document Format) : A computer file format created by Adobe Systems. The specificity of PDF is to preserve the formatting (fonts, images, graphic objects, etc.) of any source document.
ARTICLE 1 – GENERAL INFORMATION
These general conditions, which may be revised at any time, apply to all subscriptions, ebooks and training courses available online on the website https://www.the-french-style.com
Any order implies the buyer’s full and unreserved acceptance of these general conditions of sale.
ARTICLE 2 – PRICES
The prices invoiced to the customer are those in force on the day the order is registered.
Subscription rates may be changed at any time with a full month’s notice, without liability to the customer.
Prices are given in Euros including VAT.
ARTICLE 3 – SUBSCRIPTION CONDITIONS
Stylee.fr online subscriptions are monthly and are tacitly renewed, unless deleted in the My Account section or suspended by PayPal, before the subscription expires.
They begin on the day the order is placed.
Online subscriptions give access to the private parts of the website and allow standard use.
Any consultation of the private parts of the website is subject to a valid subscription.
The-French-Style.com reserves the right to terminate any subscription, without compensation, in the event of failure by the subscriber to comply with any of the provisions mentioned in these general conditions.
This will be the case in particular in the event of abnormal use of the subscription in relation to standard use.
ARTICLE 4 – ORDERING, PAYMENT AND DELIVERY
Once the order has been validated online, the customer receives a confirmation of the order by e-mail to the e-mail address associated with the customer account.
The sending of this e-mail shall constitute an acknowledgement of receipt of the customer’s order.
The purchase price of his order will be automatically debited, even if he decides later to renounce the subscription, the download or the consultation of the ordered ebook.
The customer acknowledges that the 14-day withdrawal period provided for in Article L.121-21 of the French Consumer Code does not apply if the order has been fulfilled by sending download links. By clicking on the download links contained in the order confirmation, the customer expressly waives the withdrawal period provided for in Article L.121-21.
The customer may exercise his or her right of withdrawal within a period of 14 days from receipt of his or her order confirmation by using the form made available by Service-public.fr before having clicked on the links for downloading the digital content purchased.
In the event of difficulties, and in particular if the customer does not receive the download or online reading links on the e-mail address associated with his or her customer account, he or she can contact the after-sales service by e-mail: contact@the-french-style.com
ARTICLE 5- TERMS OF PAYMENT
Our prices include VAT.
Payment is made in cash at the time of ordering, without discount, by PayPal or by credit card.
In principle, payment of the subscription fee is a prerequisite for the creation of the subscriber’s account to access the private parts of the website.
ARTICLE 6 – RIGHT OF USE AND REPRODUCTION
All the content to which the Stylée.fr website gives access in the context of the online subscriptions referred to herein is protected by copyright and database law, in application of the provisions of the Intellectual Property Code.
The subscriber is therefore prohibited from publishing, distributing or selling, in any way whatsoever, the content accessed.
Taking out an online subscription to the private parts of the website does not entail any transfer of ownership of any kind to the subscriber.
The subscriber shall also refrain from infringing in any way whatsoever the rights of reproduction, representation and other rights held by The-French-Style.com under the provisions of the Intellectual Property Code.
Thus, the subscriber shall refrain from any qualitatively or quantitatively substantial reproduction, extraction or reuse of the content of the Databases accessible from the website, as well as from the repeated and systematic extraction or reuse of qualitatively or quantitatively insubstantial parts of the content of these Databases.
Any other use not provided for by the Intellectual Property Code is subject to the prior written authorisation of Stylée.fr.
ARTICLE 7 – LIABILITIES
The subscriber is solely responsible for the consultation, selection, use and interpretation of the documentation provided by The-French-Style.com
The-French-Style.com cannot be held liable, either to third parties or to the subscriber, for the consequences of the use of the search results by the subscriber or of omissions following an unsuccessful, defective, partial or erroneous search, or for the misuse of the answers and content consulted.
Consequently, The-French-Style.com cannot be held, because of an express or tacit obligation, as civilly responsible towards the subscriber or third parties for any direct or indirect damage resulting from the use of the information, and in particular as a result of inaccurate or incomplete information, an indexing error or a delay in putting the information online.
Under no circumstances shall The-French-Style.com be held responsible for any damage whatsoever, in particular operating loss, loss of data or any other financial loss resulting from the use or impossibility of using the online subscriptions referred to herein.
Any assistance provided by The-French-Style.com in the use of online subscriptions shall not create any additional guarantee to these conditions.
ARTICLE 8 – ACCESS TO ONLINE SERVICES
Stylée.fr undertakes to implement all means enabling the subscriber to benefit from reliable and rapid access to the various contents of the website.
The subscriber declares that he/she has accepted the costs and limitations of any connection to the Internet.
The subscriber is responsible for accessing the website services in good technical conditions – hardware, software, telecommunications – in order to ensure, among other things, all backup measures and protection against possible intrusions.
The information contained on the website is accessible 24 hours a day, 7 days a week, subject to accidental or necessary interruptions for the proper functioning of the service.
This interruption does not give rise to any compensation.
After acceptance of the subscription contract signed by the customer, whether a natural or legal person, The-French-Style.com assigns access codes and passwords to the subscriber.
These are personal, confidential and non-transferable.
The subscriber is solely responsible for the use of access codes and passwords.
If the subscriber needs to modify, lose or steal his/her identifiers, he/she must notify The-French-Style.com in writing as soon as possible. The-French-Style.com will cancel the subscription upon receipt and confirm it to the subscriber.
Any use of the service made prior to such cancellation shall remain the responsibility of the subscriber.
ARTICLE 9 – APPLICABLE LAW AND JURISDICTION
This contract is subject to French law.
In the event of a dispute, the French courts will have exclusive jurisdiction.
